Welcome to Aria Music Lessons (“we,” “us,” “our”). By subscribing to or using our services on www.ariamusiclessons.com (the "Site"), you agree to comply with and be bound by the following Terms and Conditions ("Terms"). Please read these Terms carefully before subscribing to or using our piano tutoring services. If you do not agree to these Terms, you should not access or use our services.

 

1. Services Provided

  • Aria Music Lessons provides online and/or in-person private piano tutoring sessions ("Services") on a subscription basis.

  • Services may include one-on-one tutoring, lesson plans, video tutorials, and other educational materials, as outlined on our Site.

  • The specific details of the subscription, including the frequency and length of lessons, will be made clear to you upon selecting a plan.

 

2. Subscription Plans and Payment

  • By subscribing to our Services, you agree to pay the applicable monthly subscription fee for the plan you choose, as specified on our Site.

  • Subscription fees are billed monthly and will be charged to your provided payment method.

  • You will be billed automatically at the start of each month, and your subscription will automatically renew unless you cancel it in accordance with our cancellation policy.

  • There is no charge to enroll in any subscription plan.

  • Plan prices are subject to change at our discretion. If we adjust the price of any subscription plan, you will be notified in advance before any price changes take effect.

  • We accept payments via credit card.

  • Subscription must be fully paid before the first lesson or any Services are rendered. If the subscription payment is not received, no lessons or Services will be provided until payment is made in full.

 

3. Account Registration

  • To access our Services, you must create an account on our Site by providing accurate, current, and complete information during the registration process.

  • You are responsible for maintaining the confidentiality of your account credentials and are responsible for all activities that occur under your account.

  • If you suspect any unauthorized use of your account, you must notify us immediately.

 

4. Scheduling, Attendance, and Cancellations

  • Lessons must occur once per week at an agreed time every week. The scheduled lesson time will be set between you and your instructor and is subject to mutual availability.

  • Reschedule requests must be made at least 24 hours in advance. Reschedule requests made less than 24 hours in advance will not be honored.

  • If you request a reschedule within the 24-hour window, it is at the discretion of the instructor whether or not to reschedule. The instructor is not required to accommodate reschedule requests made less than 24 hours before the scheduled lesson time.

  • Aria Music Lessons allows you to reschedule lessons, but reschedules are not guaranteed. We will make every reasonable effort to accommodate rescheduling requests, but availability may be limited depending on the instructor’s schedule.

  • If you miss a lesson or do not attend a scheduled session, you will still be charged the full monthly subscription fee, and no refund or credit will be issued for missed lessons.

  • You are not entitled to a refund if you miss a lesson unless the instructor cannot attend the lesson and is unable to reschedule within a reasonable timeframe (e.g., 48 hours).

  • If you are more than fifteen (15) minutes late to a scheduled lesson, the lesson is not guaranteed to occur, and no refund or credit will be issued for the missed lesson.

  • You may pause or cancel your subscription at any time through your account settings or by contacting us directly. Cancellations will be effective at the end of the current billing cycle, and you will not be charged for future cycles.

 

5. Conduct and Expectations

  • You agree to attend your lessons promptly and participate in a respectful and professional manner.

  • You agree to use the materials provided by Aria Music Lessons for personal educational purposes only and will not distribute or share them without our written consent.

  • Instructors are expected to provide high-quality educational content, but it is your responsibility to practice and engage with the materials to achieve progress in your piano learning.

 

6. Content and Intellectual Property

  • All content provided through our Services, including lesson plans, video tutorials, and any other educational materials, is the intellectual property of Aria Music Lessons and is protected by copyright laws.

  • You are granted a limited, non-exclusive, non-transferable license to use the content solely for your personal educational use. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

 

7. Privacy and Data Collection

  • Your use of our Services is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to our collection and use of your data as described in our Privacy Policy.

  • We may collect personal details such as your name, email address, payment information, and lesson preferences to provide and improve our Services.

 

8. Disclaimers and Limitation of Liability

  • Our Services are provided "as is," and we do not guarantee that you will achieve specific results from using our tutoring sessions or materials.

  • We are not responsible for any technical issues that may arise from using the Site or our Services, including internet connectivity problems, software compatibility, or hardware issues.

  • To the fullest extent permitted by law, Aria Music Lessons will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our Site or Services.

 

9. Indemnification

  • You agree to indemnify and hold harmless Aria Music Lessons, its affiliates, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your use of our Services.

 

10. Right to Cease or Refuse Services

  • Aria Music Lessons reserves the right, at our sole discretion, to cease teaching or refuse to provide Services to any individual, for any reason or no reason at all, with or without notice. In the event that we choose to cease or refuse services, any unused portion of the subscription will not be refunded, unless otherwise required by applicable law.

 

11. Changes to the Terms

  • We may update or modify these Terms at any time, and the updated Terms will be posted on this page with the “Last Updated” date. Your continued use of the Services after any changes constitutes your acceptance of the updated Terms.

 

12. Governing Law

  • These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to its conflict of law principles.

  • Any disputes arising under or in connection with these Terms shall be resolved in the competent courts of Knox County, Tennessee.

 

13. Termination

  • We reserve the right to suspend or terminate your access to the Services if you violate these Terms or engage in behavior that is detrimental to the functioning of the Site or the community.

  • You may terminate your subscription at any time through your account or by contacting us directly. Termination will take effect at the end of the current billing cycle.
